0. INFORMATION

By playing/launching Chimps Place, or joining/chatting in the Discord server, you are agreeing to the EULA.

Use of any version of this software, authorized or unauthorized, constitutes agreement to these terms (including modded copies/apks). By installing, launching, or interacting with Chimps Place or its services, you are deemed to have accepted this EULA, even if a direct agreement screen is bypassed or removed. Tampering with or removing this agreement does not waive any rights held by the copyright owner (Phoenic Interactive). Unauthorized modification or redistribution of this software is strictly prohibited and will be pursued under applicable law. Players may report violations or abuse in game or by using the Discord “Report Bad Chimps” Channel. We review all reports and may take action at our own discretion.

1. LICENSE GRANT

Phoenic Interactive grants you a limited, non-exclusive, non-transferable, revocable license to install and use the VR game Chimps Place for personal, non-commercial use on supported platforms.

2. OWNERSHIP

Phoenic Interactive owns the majority of the code, assets, and content within Chimps Place. This game is licensed, not sold. You agree not to claim ownership of any part of the software or services.

3. RESTRICTIONS

You may not:

Use spam, or exploit webhooks, API, or any 3rd party services (such as Discord, or PlayFab) in connection with Chimps Place in any abusive, automated, malicious or disruptive manner.

Attempt to bypass, disable, or interfere with Discord server protections, moderation tools, or reports.

Engage in denial-of-service attacks, flood requests, or mass automation intended to overload or interfere with Discord servers, PlayFab or any other backend infrastructure used by Chimps Place.

Reverse engineer, decompile, disassemble, or extract/use any source code of Chimps Place.

Modify, cheat, exploit, or create unauthorized tools or hacks for Chimps Place.

Circumvent any technical protection measures or security mechanisms for Chimps Place.

Use Chimps Place for commercial purposes without written permission (From the owner/admin).

Use automation, bots, or scripts to gain unfair advantage for Chimps Place.

You may not use Chimps Place, its assets, or systems for commercial purposes (including paid mods, hosting, or access) without prior written permission from Phoenic Interactive.

3.1. THREATS, HARASSMENT, AND COERCION

You are strictly prohibited from engaging in:

Threats, harassment, or intimidation of the developer (Phoenic), any staff, or other players FOR ANY REASON.

Blackmail or coercion, such as pressuring the developer to ban/unban players, alter Chimps Place, give special items/currency, or make moderation decisions under threat.

Disruptive conduct, including threats to leak personal information, release exploits, crash servers, hack/exploit, or interfere with Chimps Place's operations or community.

Any such behavior is grounds for immediate ban and potential legal action.

4. ONLINE FEATURES

Chimps Place uses third-party services, including Photon (multiplayer networking) and PlayFab (backend systems). Use of these services is subject to their own terms and policies. Multiplayer or cloud-based features may require an internet connection. Your game data may be stored and transmitted via external servers.

4.1. VOICE CHAT RECORDING

For player safety and moderation, you agree that your in-game voice chat may be automatically recorded by the game.

This audio data is not stored or transmitted to Phoenic Interactive unless a profanity or other violation of the code of conduct is detected.

In the event a violation is detected, a portion of the audio data may be sent to Phoenic Interactive for review and enforcement action.

5. TERMINATION

Phoenic Interactive has the right and may suspend or permanently revoke or ban your access to Chimps Place at any time, without refund, for:

Violating this Agreement

Cheating, exploiting, or unauthorized modding.

Harassment, threats, blackmail, or manipulation of any kind

Attempting to interfere with Chimps Place’s operation or moderation

Encouraging or aiding others to do any of the above or break the Chimps Place code of conduct

Termination is at the sole discretion of the Phoenic Interactive team.

5.1. IN-APP PURCHASES & REVOCATION

All in-app purchases (IAP) represent a limited, non-transferable, revocable license to use virtual items, currency, or other content within the game. You do not own these virtual items or currency. Phoenic Interactive reserves the right to revoke this license and remove any virtual item, currency, or content from your account at any time, for any reason, including but not limited to:

Fraudulent activity or chargebacks

Violations of this EULA or the game's code of conduct

Abuse of in-game systems or exploits

At the sole discretion of Phoenic Interactive

In the event of such a revocation, you agree that no refund will be issued for the revoked IAP, as the license to use the content has been terminated.

6. USER-GENERATED CONTENT

Chimps Place allows user-created content, you grant Phoenic Interactive a non-exclusive, royalty-free license to use, display, and promote that content within Chimps Place or related materials (Fan Art, game posters). You are solely responsible for any content you submit, share, or transmit through Chimps Place or related services. Phoenic Interactive assumes no liability for user-generated content and reserves the right to remove or moderate such content at any time. You agree not to upload offensive, illegal, or infringing content.

7. LIMITATION OF LIABILITY

Chimps Place is provided "as is." Phoenic Interactive is not liable for any indirect, incidental, or consequential damages, including data loss, account issues, or disruption of service.

8. GOVERNING LAW

This Agreement is governed by the laws of the United States, without reference to conflict of laws. Disputes shall be resolved under applicable U.S. law.

9. ACCOUNT ENFORCEMENT & BANS

Phoenic Interactive reserves the right to suspend, restrict, or permanently ban any user account at our sole discretion, without prior notice. Ban durations, conditions, and reversals are determined exclusively by Phoenic Interactive and are not subject to outside influence or demands. By using Chimps Place or associated services (such as our Discord community), you agree that we are under no obligation to justify moderation actions or provide appeals unless we choose to do so.

11. UNAUTHORIZED COPIES & APK DISTRIBUTION

You may not download, distribute, or promote unauthorized builds, cracked APKs, or repackaged versions of Chimps Place. This includes versions of Chimps Place that bypass authentication, modify gameplay, or remove this EULA. Phoenic Interactive reserves the right to issue takedowns, file DMCA notices, and pursue legal action against unauthorized distribution, even on third-party platforms like Google Drive, MediaFire, or Discord.
